Filing Dissolution of Marriage in El Paso County

To file for dissolution of marriage in El Paso County, at least one spouse must have lived in Texas for six months and in El Paso County for 90 days. This rule comes from Texas Family Code § 6.301. Once you meet the residency requirement, file the Original Petition for Dissolution with the District Clerk at the El Paso County Courthouse.

Texas mandates a 60-day waiting period after filing before the dissolution can be granted. The court will not sign the Final Decree until the 60 days are up. In El Paso County, the case is assigned to one of the family district courts and proceeds according to that court's docket.
